Unless your taking that $10 constitutes some sort of contract that precludes otherwise, eBay will surely find in your favor and the seller is responsible for the cost of return shipping (You'd get the full cost including shipping back and my guess is that the seller won't even bother sending the prepaid shipping label and you'd be able to keep the figure as well (not that I believe you care/want it).  It's not my place to tell you what you should do, but you have nothing to lose and everything to gain by filing a claim.

I'm also one of those idealists who believes everyone has a responsibility to do this sort of thing to protect others from future incidents such as this.

I'm reluctant to comment more before this really comes to anything, but he became extremely aggressive after I sent a claim for a return. He is flooding me with angry messages through Facebook and Ebay, so I thought I should double down on my original negative feedback left here.

I'm saving all of them of course should anyone be (fairly) skeptical and want to see, though I felt this was worth sharing immediately rather than waiting to see if Ebay is willing to step in.

I am really sorry you have had this experience since I encouraged you to buy your holy grail. Unfortunately I knew nothing about this seller. If he sends or posts anything threatening you should forward those notes to eBay and he could face a ban. Sounds like a real jerk.

All communication should be kept within the eBay messaging system so eBay will have it.  Send or link to anything else that might be helpful and certainly anything really inappropriate.  Hopefully you already made it very clear that the item arrived in a deteriorating condition and the seller knows this isn't unusual.  This is the basis for the refund.  But everything else helps.

If you are confident and well spoken, you might find a reason  (You're stressed by it and just want to ask if there's anything else you can/should do (Send the outside communication?) to support the claim...) to call eBay customer service to discuss the claim and often the reps will assure you in advance that it will be decided in your favor.

I'm sorry you're going through this but good for you for sticking up for yourself and calling the seller to task.  And you have nothing to lose. Good luck.

Should've said this earlier but I sincerely recommend paintingdinos here on the board. Had one of my Carnegie Collection Tyrannosaurus repainted by her and had an excellent experience.
